Terms of Service (EULA)

Welcome to Tropic! These Terms of Service ("Terms" or "EULA") govern your use of the Tropic mobile application ("App") provided by Jean-Sébastien Wallez ("we", "our", or "us"). By using the App, you agree to these Terms.

1. Acceptance of Terms

By downloading, installing, or using Tropic, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

2. Description of Service

Tropic is an iOS application that allows you to:

Record and transcribe voice narrations
Import and tag video clips from your Camera Roll
Generate short-form videos by matching narration to tagged clips
Export videos for sharing on social media

3. Subscriptions and Payments

Free Tier

The App offers limited free functionality, including up to 3 transcriptions per month.

Tropic+ Subscription

Premium features are available through a paid auto-renewable subscription called "Tropic+", which includes:

Unlimited transcriptions
AI-powered video tagging
Smart clip matching

Subscription Options

Tropic+ Weekly: $4.99 USD per week
Tropic+ Monthly: $9.99 USD per month
Tropic+ Yearly: $59.99 USD per year

Auto-Renewal Terms

Payment will be charged to your Apple ID account at confirmation of purchase
Your subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period
Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price
You can manage and cancel your subscriptions by going to your App Store account settings after purchase
Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription

Managing Your Subscription

To cancel or manage your subscription:

Open the Settings app on your iPhone
Tap your name at the top
Tap "Subscriptions"
Select "Tropic+" and choose "Cancel Subscription"

4. Your Content

You retain all rights to the content you create, import, or generate using the App, including:

Audio recordings
Video clips
Generated videos
Tags and metadata

You are solely responsible for ensuring you have the necessary rights to use any content you import into the App.

5. Acceptable Use

You agree not to use the App to:

Create, distribute, or share illegal content
Infringe on the intellectual property rights of others
Harass, abuse, or harm others
Distribute malware or engage in hacking activities
Violate any applicable laws or regulations

6. Intellectual Property

The App, including its design, features, and code, is owned by us and protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer the App.

7. Third-Party Services

The App uses third-party services to provide certain features:

Google Gemini API: For audio transcription and video analysis
RevenueCat: For subscription management
Mixpanel: For analytics

Your use of these services is subject to their respective terms and privacy policies.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP OR SUBSCRIPTION IN THE PAST 12 MONTHS.

10. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the App or violation of these Terms.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes through the App or by other means. Continued use of the App after changes constitutes acceptance of the new Terms.

12. Termination

We may terminate or suspend your access to the App at any time for violation of these Terms. You may stop using the App at any time by deleting it from your device.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions.
